Conditions of sale
Art.1 – PURCHAISING METHOD
1.1. To place an order, follow the steps below:
I) Tap on the desired product and click “add to cart”. On this page you will find the item description and the total price. The total price will include the shipping costs and taxes. (Some specific customs duties are not included).
II) When you’re ready to place your order, tap on “proceed to checkout” and fill in the requested information. Before confirming the order the customer must review and verify the accurancy of the data entered, the shipping address and the choosen payment method. The customer is required to verify the accuracy of the data entered, for which the truthfulness is responsible;
III) Please read carefully the “Terms and Conditions”. The “Terms and Conditions” are binding on the customer declares to have read and accepted them by checking the box “I accept the Terms and Conditions of Sale” before finalizing the online ordering process.
IV) Once clicked on “Place order” the customer shall fulfill his payment obligation based on the order and its confirmation, in the way specified therein. .
1.2 .The customer will receive an order confirmation email which will include the description of the item purchased , the price, the delivery costs and the chosen method of payment. The Conditions for exercising the right of withdrawal will be indicated in accordance with Art.6.
1.3. The contract is intended as a binding purchase agreement. Your order confirmation email sent by “La Grenouille Ceramiche” acts as your proof of purchase.
1.4. The realization and the sale of customized products is in accordance with a specific request from the customer. It must be requested following the instructions on the website. Advance payment will be required and the right of withdrawal will be excluded from the purchase contract.
Art.2- SHIPPING/ DELIVERY TIME
2.1. “La Grenouille Ceramiche” will deliver directly to the customer’s address via DHL Express. The buyer can use DHL tracking number to track the status of the parcel.
2.2. Delivery times: within three / four working days the products are delivered to the courier. The shipping time depends on the destination country. Orders shipped in Italy are guaranteed by the courier to be delivered within 1/3 working days. The delivery time is indicative and not strictly binding for “La Grenouille Ceramiche”
2.3. Orders shipped outside the Italian territory are guaranteed by the courier company to be delivered within 2/5 working days. The delivery time is indicative and not strictly binding for “La Grenouille Ceramiche”
Art. 3 – REGISTRATION
For purchasing on our website a prior registration is not required. The user can still choose to register: registration is free, fast and does not entail any purchase obligation. The customer will be automatically registered after his first order and will receive a generic password, which can be immediately changed using the link found in the confirmation email. The Customer undertakes to provide correct, truthful and complete data regarding: personal details, personal contact details, other useful information for processing the order.
Art.4 – PRICE, PAYMENT AND TAX DOCUMENT
4.1. The prices are intended in Euros (€).
4.2. The total price at the end of the order is inclusive of shipping costs. Customs duties and / or additional import taxes are not included. Any additional charges for customs clearance operations shall be paid exclusively by the recipient.
4.3. The accepted methods of payment are: PayPal and bank transfer in advance.
PayPal
If you decide to purchase with PayPal, after confirming the order, you will be taken directly to the PayPal checkout page (the transaction is safe and protected by SSL). Enter your PayPal login credentials.
Once the payment is accepted, PayPal will charge the amount of the purchase and send us your order confirmation email.
At no time during the purchase procedure “La Grenouille Ceramiche” will be able to know the credit card information of the purchaser.
By using PayPal you can take advantage of the “Purchase Protection”service and other benefits provided by the ‘Terms of Use’ on www.paypal.com.
Bank Transfer (Payment in Advance)
If you prefer, you can pay with a bank transfer in advance using the bank details that you will receive by e-mail after confirming your order.
This payment method might slow your order managing process. In this case we need to receive the bank transfer confirmation before shipping the items you have purchased. When you’ll receive the e-mail containing the bank account information, you will have 7 days to bank transfer the amount due.
After this deadline, the order will be considered canceled (you will receive a communication via email).
In case of payment with bank transfer, the “reason of payment” must report: the order reference number, the order’s date and the name and surname of the order’s holder.
Once the bank transfer has been made, we recommend the buyer to send us proof of the bank transfer (paper receipt or online bank transfer confirmation).
4.4. The tax documentation will be attached to the parcel.
Art.5 – CASE OF FORCE MAJEURE
In the event that for any reason whatsoever the contract cannot be concluded (even in part), due to the unavailability of the goods or for other reasons of force majeure, “La Grenouille Ceramiche” will inform the customer by email within thirty days of the date on which the order was placed. “La Grenouille Ceramiche” shall be relieved without liability of all obligations under the Contract except for the reimbursement of any amounts already paid by the latter.
Art.6 – RIGHT OF WITHDRAWAL
6.1. According to Articles Art. 52 and ss. d. lgs n. 21/2014, the Customer has the right to withdraw from this contract, without penalty and without specifying the reason, within 14 (fourteen) working days from the date on which the Buyer has acquired physical possession of the ordered goods
6.2. Before the withdrawal period expires (within 14 working days) the customer may exercise the right of withdrawal by informing by email “La Grenouille Ceramiche” (luisa@lagrenouilleceramiche.it) of his/her decision to withdraw from the contract.
6.3. In case the customer chooses to exercise the right of withdrawal, the Buyer is obliged to return the goods within 14 days from the date on which he/she has communicated to the “La Grenouille Ceramiche” his/her wish to withdraw from the contract. The goods must be returned to the “La Grenouille Ceramiche” headquarters in Via Rossini 21, 37024 Negrar di Valpolicella (VR). The deadline shall be deemed to have complied with the time limit prescribed.
6.4 The Consumer shall be charged for the direct cost of returning the goods.
6.5. The goods must be returned intact, in the original packaging and complete in all their parts.
6.6. Without prejudice to the right to verify compliance with the above, “La Grenouille Ceramiche” will reimburse the amount paid by the customer for the goods covered by the withdrawal within a maximum period of 30 days,
As provided by art. no. 56, paragraph 3, of Italian Legislative Decree and as amended by Italian Legislative Decree no. 21/2014, “ La Grenouille Ceramiche” may suspend the refund until the receipt of the goods or until the Buyer has demonstrated that he/she has returned the goods to “La Grenouille Ceramiche”
6.7. The right of withdrawal is not provided for purchases made by companies and/or professionals. Retailers and companies, among others, are excluded from the right of withdrawal.
6.8. The right of withdrawal is also excluded, pursuant to Art. 59 of Legislative Decree no. 21/2014, in the case of supply of customized goods (see previous Art.2.6.).
Art. 7 – PRIVACY
The data provided by the Customer required to execute the Contract are treated in compliance with the dispositions of the Decree Law 2003 n. 196 of “Protection of the personal data”.
Art.8 – APPLICABLE LAW AND JURISDICTION
8.1. The parties, stipulating the contract pursuant to the previous Art.2, agree that it is governed by Italian law and subject to Italian jurisdiction.
8.2. For any dispute concerning the validity, execution or interpretation of the contract and its effects, the following will be competent: a) the Court of the place of residence or domicile of the Customer, if the Customer is a Consumer and is resident or domiciled in Italy; b) the Court of Verona exclusively, in any other case.
